Requirements for the New Jersey Intensive Supervised Probation Program
New Jersey’s intensive supervised probation program is only available to individuals who have been convicted of certain non-violent crimes and allows an eligible individual to leave prison and instead satisfy a term of supervised release. Before applying to participate, you will be required to complete at least 60 days of your jail sentence. After release from prison via the ISP program, a 90-day “trial period” will begin. Throughout the entire term of intensive supervision, you will be required to:
- First, obtain employment within 30 days of release, and maintain employment throughout the supervisory period,
- Abide by a strict 6pm curfew before you gain employment,
- Provide financial support for any dependents,
- Participate in mandatory treatment and/or counseling programs,
- Obtain permission before leaving the state of New Jersey at any time,
- Refrain from carrying a firearm,
- Submit to home visits by an ISP officer, and allow the officer to search the premises without a warrant,
- Inform your employer that you are a participant in the ISP program,
- Submit to random drug and alcohol testing, and
- Satisfy all financial conditions ordered under the ISP program.
If your original prison sentence was at least five years, you will be required to remain under intensive supervision for at least 16 months following release, and potentially for the remainder of your original prison sentence. Even once you have been admitted into the program, you will be required to complete all conditions and continue to satisfy the judges that you should be allowed to continue to participate.

What information will the screening board consider in determining whether I will be admitted into the intensive supervision probation program?
All of the facts and circumstances of your case are relevant in determining whether you will gain entry into the ISP program. The screening board will first examine your criminal record and evaluate the crime for which you are serving prison time to determine initial eligibility. The judges will also evaluate whether you present any risk to public safety and whether it is expected that you will re-adjust to living positively within the community.
Is anyone specifically excluded from participation in New Jersey’s intensive supervision probation program?
Yes. If you have been convicted of certain violent crimes, including homicide, vehicular homicide, sex crimes, robbery, organized crimes, as well as certain other first-degree crimes, you will not be eligible to apply for the ISP program. Further, those who have already participated in the intensive supervision probation program in the past are ineligible. ISP is also not available if you have been convicted of a first-degree crime, or if the current criminal conviction is one that carries a minimum term of parole ineligibility, including those crimes that fall under the Graves Act (relating to illegal firearms convictions). If the prosecutor objects to your participation in the ISP program and you have been convicted of a second-degree crime, you may be ineligible until you have served at least six months of your prison sentence and come within nine months of traditional parole eligibility.
