NJ Man Faces Aggravated Sexual Assault Charges in Burlington County
A New Jersey man was charged with breaking into a woman’s home for the purpose of committing sexual assault. He entered the woman’s apartment through a window and allegedly sexually assaulted her at gunpoint in the early morning hours.
Police obtained a search warrant at the accused’s residence. He has been charged with aggravated sexual assault, burglary, robbery, two counts of unlawful weapons possession, terroristic threats, and criminal restraint. He is in custody at the Burlington County jail. A Superior Court hearing is scheduled.

Under NJ Rev Stat § 2C:14-2 (2014), a person is guilty of an act of aggravated sexual assault or rape:
- if sexual penetration of another individual occurs
- if the actor has a dangerous weapon or leads the victim to believe he has a weapon or threats/gestures to use the weapon
Aggravated sexual assault is a first-degree crime in New Jersey. If convicted, the defendant faces a minimum 25-year to maximum life in prison sentence. If eligible for parole, the defendant would be required to serve at least 25 years of the prison term.
The lesser charge of sexual assault is a second-degree crime in New Jersey. If convicted of sexual assault, the offender faces a minimum 15-year prison term. If parole-eligible, he would be required to serve at least 15 years in prison.
A charge of aggravated sexual assault is a very serious matter. However, the court may accept a “negotiated plea agreement.” In that instance, the individual receives the imprisonment term and parole ineligibility as specified in the agreement.
