Cherry Hill Criminal Lawyer Reports on Accidental Shooting Involving Police Officer

Ocean County Prosecutor’s Office Investigates Accidental Shooting by Police Officer

A 23-year-old Pine Beach police officer has been suspended without pay, arrested for drunk driving, and could face criminal charges for a shooting incident that occurred shortly before 6:00 am on Friday, January 16, 2015 in Lacey Township, NJ.  The Ocean County Prosecutor’s Office is investigating the shooting and has indicated that the shooting may have been accidental.
Lacey police responded to a 911 call made by the police officer from a 7-11 parking lot in which he reported that he had accidently shot his friend in the leg.  He was off duty at the time of the incident.  The unidentified 23 year old victim was taken to Jersey Shore University Medical Center to undergo surgery for his injuries which are not life threatening.
The Ocean County Prosecutors Office claims they gathered enough evidence to charge the police officer with DUI.  They also allege that the shooting happened at another location before he drove his injured friend to the 7-11 and called 911.  The circumstances concerning the accidental discharge of the police officer’s weapon are under investigation by the Ocean County Prosecutors Office, Lacey Township Police, and Pine Beach Police.
Not only could this accident result in criminal penalties for the officer, but his career as a police officer is in jeopardy as well.  Individuals facing weapons charges for accidental shootings need a highly skilled criminal defense lawyer to fight aggressively in their defense. Weapons offenses of any kind are very serious in New Jersey.  Even where a shooting is accidental, criminal charges may follow the unlawful possession of a weapon.  Perhaps a police officer may escape those charges but with regular citizens defenses to the possession of a weapon must be made.
